1. General Provisions

1.1. The Privacy Policy hereto shall regulate the main principles and procedure of processing personal information of NORAMEDA customers (hereinafter referred to as You, Your, etc.) by NORAMEDA Private Limited Company (company Reg. No. 140744584, address: Meistrų g. 8A, Vilnius, correspondence address: Gynėjų g. 16, Vilnius; hereinafter referred to as NORAMEDA) collected in the process of browsing the websites www.norameda.com and www.gudruciovaistine.lt (hereinafter individually and collectively referred to as NORAMEDA Website).

1.2. The purpose of the Privacy Policy is to inform you about processing of your personal data by NORAMEDA. Personal data is any information relating to an identified or identifiable natural person: surname, name, telephone number, e-mail address or mailing address, information about the purchase (date, goods, price, quantity, amount, discount) and any other information (hereinafter referred to as the Personal Data). 

1.3. You can access the NORAMEDA Privacy Policy document at any time on the NORAMEDA website or download it from NORAMEDA website and print it out. 

1.4. NORAMEDA is the controller of your Personal Data.

1.5. The collection, processing and storage of your Personal Data shall be regulated by the Privacy Policy hereto, the Law on Legal Protection of Personal Data of the Republic of Lithuania, the Law on Electronic Communications of the Republic of Lithuania, the Rules of Processing of Personal Data of NORAMEDA, UAB and also by the General Data Protection Regulation No 2016/679 (since 25 May 2018) (hereinafter referred to as the GDPR).

1.6. By using the NORAMEDA website you confirm that you are aware that NORAMEDA shall control and process your Personal Data with the means, for the purposes and in accordance with the procedure laid down in the Privacy Policy hereto.

1.7. NORAMEDA shall follow the following principles of processing of Personal Data:

1.7.1. Personal Data shall be processed lawfully, fairly and in a transparent manner.

1.7.2. Personal Data shall be collected for specified, explicit and legitimate purposes and shall not be further processed in a manner that is incompatible with those purposes.

1.7.3. Personal Data shall be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

1.7.4. Personal data shall be processed lawfully, i.e. only if and to the extent that:

1.7.4.1. You have given consent or it is possible to conclude that you have given consent for the use of your Personal Data for the specific purpose (e.g., when you register to receive the newsletter, take part in surveys, games (quizzes), when you submit your order and answer any other questions about your contact details); 

1.7.4.2. A contract to which you are party, has been concluded or is being performed;

1.7.4.3. Processing of Personal Data is necessary for the purposes of the legitimate interests pursued by NORAMEDA or by a third party to which Personal Data are provided, except where such interests are overridden by your interests or fundamental rights and freedoms, which require protection of Personal Data;

1.7.4.4. Processing of Personal Data is necessary for the purposes of compliance with a legal obligation to which NORAMEDA is subject.

1.7.5. Personal data are accurate and, where necessary, kept up to date.

1.7.6. Personal Data are kept in a form which permits your identification for no longer than is necessary for the purposes for which the Personal Data are processed.

1.7.7. Personal Data are processed in a manner that ensures appropriate security of the Personal Data; the data are processed only by the authorized employees.

1.7.8. All information about the Personal Data which are being processed is confidential, except the cases when disclosure thereof is required by the legal acts.

1.8. The services offered at the NORAMEDA website may be used by the following:

1.8.1. All legally capable natural persons who are at least 18 years of age;

1.8.2. Legal entities;

1.8.3. Authorized representatives of such natural persons/legal entities.

2. Collection and Other Processing of Personal Data and the Period for which the Personal Data are Stored

2.1. NORAMEDA respects your right to privacy. Your Personal Data shall be collected and otherwise processed for the following purposes:

2.1.1. For the processing of your orders for services;

2.1.2. For the purposes of issuing the financial documents;

2.1.3. For the purposes of resolving the problems related with the provision of services;

2.1.4. For the purposes of performance of other contractual obligations;

2.1.5. For the purposes of online marketing;

2.1.6. For direct marketing purposes of (in order to offer the goods and services to persons and (or) ask their opinion about the goods and services offered to them);

2.1.7. For the purposes of administration of electronic queries and comments;

2.1.8. For the purposes of pharmacovigilance (handling of complaints);

2.1.9. Information is obtained and generated while you are using the NORAMEDA website as laid down in paragraph 3 for the purposes specified therein.

2.2. The Personal Data provided by you must be comprehensive and true. This is necessary for the purposes of concluding a contract or performing the contract concluded with you. Provision of Personal Data for the purposes of pharmacovigilance is the requirement laid down in the legal acts. If you refuse to provide Personal Data for the said purposes, NORAMEDA shall not have a possibility to ensure the proper performance of the contract concluded with you or the order submitted by you in the e-shop, and compliance with the legal obligations related with pharmacovigilance requirements.  

2.3. When processing and storing your Personal Data, NORAMEDA shall implement the organizational and technical measures to ensure protection of the Personal Data against any accidental or unlawful destruction, alteration, disclosure, including any other unauthorized processing. The premises where the data collected are stored shall be physically protected against any unauthorised access. Your Personal Data shall be protected against any unauthorised access with the help of computer networks.

2.4. Your Personal Data shall be processed: 

2.4.1. For direct marketing purposes of (in order to offer the goods and services to persons and (or) ask their opinion about the goods and services offered to them) - for a term of 10 years from the moment of receipt of the consent for the processing of Personal Data (or from the moment of receipt of the data when consent is not mandatory);

2.4.2. For the purposes of administration of electronic queries – for a term of 2 months, and for the purposes of administration of comments – for a term of 3 years from the date of submission;

2.4.3. For the purposes of electronic trade – for a term of 2 years from the last purchase made by the client or the last login to the client’s account;

2.4.4. For the purposes of pharmacovigilance (handling of complaints) – for a term of 5 years from the moment of the notification about the side effects of the medication;

2.4.5. If your data were used for the commission of an illegal act or for the purposes of identity theft or for any other infringement in relation to which the relevant law enforcement authorities conducted or would conduct an investigation, if NORAMEDA is in receipt of the complaints pertaining to you or if NORAMEDA notices any violations by you of the Privacy Policy and/or the Rules available on the NORAMEDA website, also in the event of any intentions to file, comply with or protect any legal claims, your Personal Data may be processed for as long as is necessary in such cases.

2.5. After the expiry of the abovementioned terms, your Personal Data shall be destroyed automatically.

2.6. NORAMEDA may use the anonymised data directly not related with your person, i.e. the data about the ordered services, for statistical purposes. Such statistical data shall be collected and processed in such a manner as not to disclose the person’s identity or any other personal data which could enable identification of the person.

2.7. You shall use the NORAMEDA website and download the data at your own risk. NORAMEDA shall not be liable for any loss possibly suffered by you due to this, especially if such loss may be inflicted to your datasets, hardware and (or) software.

3. Ways of Obtaining Information

3.1. NORAMEDA shall be entitled to use information obtained while you are browsing NORAMEDA website in the following ways:

3.1.1. Your IP address: your IP address is a numerical label assigned automatically by your provider of internet services to the computer used by you. IP address is identified and registered in your server log together with the timing of your visit and the page(s) visited by you. Collection of IP addresses is the standard practice on the internet, which is automatically performed by a number of websites.

NORAMEDA shall use the IP addresses for such purposes as recording the level of use of the NORAMEDA website, server problems and administration of NORAMEDA website. NORAMEDA may also use and disclose them for any purposes for which any other personal data are used. Please note that the IP addresses, the server log entries and the related information shall be treated by NORAMEDA as Personal Data, where this is laid down by the laws and other applicable legal acts. 

3.1.2. Your browser information: a number of browsers collect certain types of information such as media access control (MAC), your computer type (Windows or Macintosh), screen resolution, operational system, internet browser and version, cookies (the Cookie Policy is listed below), pixel tags, web beacons and other similar technologies.

4. Protection of Data and Use of Facebook

4.1. NORAMEDA website uses plugins of the social network www.facebook.com. The said network is managed by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (hereinafter referred to as Facebook).

4.2. When, while using the NORAMEDA website, you retrieve the web pages with such a plugin, you log in to the Facebook servers, your browser receives the respective notification and the website displays the plugin. Thus, the Facebook server receives information about the specific NORAMEDA website pages visited by you. If you are registered as a Facebook member, Facebook attributes such information to your personal Facebook user account. When using the plugin functions (e.g. by pressing the button “Like”, by leaving a comment) such data are also attributed to your Facebook account. If you do not wish Facebook to collect data about you via the NORAMEDA website, you must log out of Facebook before visiting NORAMEDA website.

4.3. The Facebook plugin does not have any effect on the data collected by NORAMEDA, therefore you are provided with the information which is within the level of knowledge of NORAMEDA. More information about the data collected and used by Facebook, your rights related thereto, your privacy protection possibilities is provided in the Facebook privacy notifications.

5. Use of Personal Data for Marketing (Advertising and Market Research) Purposes

5.1. NORAMEDA shall also provide the following services:

5.1.1. Send newsletters with the latest offers / advertising of goods, ask for the client opinion about the goods and services offered;

5.1.2. Register as the regular customer.

5.2. If you have given your explicit consent for the use of your Personal Data for direct marketing (advertising and market research) purposes (e.g., you tick the relevant box while performing acts on NORAMEDA website pages), your Personal Data shall be saved and used for the said purposes.

5.3. For example, in such a case NORAMEDA shall send advertisements of the products and other offers by NORAMEDA Company. For that purpose, NORAMEDA shall use such communication channels, which are specified by you to NORAMEDA in your consent, for example, by e-mail if you specify your e-mail address to NORAMEDA; by telephone, SMS message or via the mobile applications if you specify your (mobile) telephone number to NORAMEDA; by regular mail (mail items) if you provide your address to NORAMEDA.

5.4. If you have given your explicit consent for the use of your Personal Data for direct marketing (advertising and market research) purposes, this means that you have enabled NORAMEDA to send advertisements of the services offered on the NORAMEDA website to you by mail. Besides, by using your data, NORAMEDA may create and administer the user account which is necessary for the purposes of ensuring that you receive the specific advertisements, which, in the opinion of NORAMEDA, could be interesting to you. 

5.5. If you have given your explicit consent for the use of your Personal Data for direct marketing (advertising and market research) purposes, NORAMEDA may use your data for the analysis and improvement of the efficiency of its websites, advertisements and market research as well as for any other marketing and promotional purposes.

5.6. After the execution of your order, NORAMEDA may send an e-mail message to you with a request to assess the work performed by NORAMEDA.

6. Transfer of Personal Data to the Third Persons 

6.1. Your Personal Data may be processed by NORAMEDA data processors – provider of server services, website administrator and the companies engaged in the delivery of postal items – to the extent necessary for the performance of their functions. NORAMEDA shall have the right to transfer the Personal Data to the third persons only in accordance with the procedure and on the grounds laid down in the laws and other legal acts of the Republic of Lithuania.

6.2. For the purposes of improving the supply of NORAMEDA products, NORAMEDA shall apply personified assessment of the NORAMEDA links that were used. You give you consent for such a practice at the time of your registration. Therefore, it may be necessary for NORAMEDA to transfer your Personal Data for further processing to other companies of the NORAMEDA Group or to other companies which are providers of its services. For example, such providers of services may be authorized to send newsletters to you.

6.3. NORAMEDA hereby warrants that your Personal Data shall not be transferred to the third persons for the purposes of gaining profit. However, NORAMEDA reserves the right to provide information about you if the company were bound to do this in accordance with the procedure laid down by the laws or if NORAMEDA were required to do so by lawful authorities or by the authorities conducting criminal prosecution.

6.4. Your Personal Data shall not be provided to the third states.

7. Your Rights

7.1. You shall have the right to adjust and / or update the information presented in the registration form.

7.2. You shall be obliged to specify the correct Personal Data in the registration forms. NORAMEDA shall not be liable for the correctness of the Personal Data specified in the registration forms or for any loss suffered due to incorrect Personal Data.

7.3. If the Personal Data are processed with your consent, you shall have the right to withdraw your consent for the processing of your Personal Data at any time by notifying about this personally or in writing to the following address: Gynėjų g. 16, 01108, Vilnius, or by e-mail to info@norameda.lt and by providing your identification documents or certified copies thereof. Withdrawal shall not have any effect on the validity of processing of the data performed on the basis of the consent before the withdrawal of the consent. If you object to or withdraw your consent for the processing of the Personal Data for direct marketing purposes, such processing of the data shall be discontinued and your account and Personal Data shall be destroyed.  

7.4. You shall also have the following rights:

7.4.1. To receive confirmation from NORAMEDA about the processing of the data related with you, and to be notified which Personal Data pertaining to you are processed by NORAMEDA and how they are processed;

7.4.2. To have inaccurate Personal Data rectified or incomplete Personal Data completed;

7.4.3. To require suspension of processing of the Personal Data, with the exception of storage, when processing of the data does not comply with the laws;

7.4.4. From the date of application of GPDR (25 May 2018) – to require restriction of processing of Personal Data on the grounds specified in the said Regulation;

7.4.5. From the date of application of GPDR – to require erasure of the Personal Data (“the right to be forgotten”) on the grounds specified in the said Regulation;

7.4.6. From the date of application of GPDR – to receive the Personal Data in a commonly used and machine-readable format where the processing of the data is performed on the basis of the consent or contract;

7.4.7. From the date of application of GPDR – to object to the processing of Personal Data, when the Personal Data are processed by NORAMEDA for legitimate interests; in such a case, NORAMEDA shall not process your Personal Data, with the exception of the cases, when it can prove that the data are processed for compelling legitimate interests, which override your interests, rights and freedoms, or for the purposes of filing, complying with or protecting any legal claims;

7.4.8. To lodge a complaint to the State Data Protection Inspectorate.

7.5. You may implement the abovementioned rights (except the right specified in subparagraph 7.4.8) by addressing NORAMEDA personally or in writing to the following address Gynėjų g. 16, 01108, Vilnius, or by an e-mail message to info@norameda.lt, by providing your identity documents or certified copies thereof. Upon receipt of your request regarding the processing of Personal Data, NORAMEDA shall provide a response to you no later than within one month of the date of your request. 

7.6. If you have any questions regarding your rights or the Privacy Policy of NORAMEDA, send e-mail to info@norameda.lt with indication “Data Protection” in the Subject section.

8. Cookie Policy

8.1. Cookies are small text files received by and stored on your computer’s browser from the website you visit. Cookies allow the NORAMEDA website to memorize the information about your browsing habits, actions, searches and settings in order to ensure the full functionality of the website and make other visits on the NORAMEDA website simpler and more useful.

9. Amendment of the Privacy Policy

9.1. NORAMEDA shall have the right to amend the Privacy Policy unilaterally in part or in full by announcing a notification of such amendment on NORAMEDA website.

9.2. If you object to the processing of your Personal Data in accordance with the new wording of the Privacy Policy, you may exercise your respective rights related with processing of your Personal Data.

9.3. Any amendments or supplements of the Privacy Policy shall become effective on the date of announcement thereof, i.e. on the date when they are made available on NORAMEDA website.
